Terms of Service

Seller: lastword.to (referred to as "lastword.to", "we", "us", or "the Service" in these terms). By creating an account or otherwise using the Service, you agree to these Terms of Service. If you do not agree, do not use the Service.

1. What this service is

lastword.to stores encrypted instructions you write, periodically asks whether you are still alive, and dispatches those instructions to recipients you specify if you stop answering for a duration you control.

2. What this service is not

The Service is not a legal will, not a substitute for estate planning, not a guarantee of delivery, and not a method for transferring property, custody, or financial accounts.

3. Your responsibilities

• You confirm you are of legal age in your jurisdiction and have authority to enter this agreement.
• Keep your email address and recipients current.
• Keep your account credentials confidential. You are responsible for activity under your account.
• Choose a check-in cadence and threshold that fits your life. We do not warn you about unreasonable settings.
• Do not misuse the Service, including: unlawful use, fraud, spam, infringement of intellectual property, interference with security (malware, probing, scraping), or storing instructions to commit unlawful acts, harass, or threaten anyone.

4. False positives

You may miss check-ins for reasons other than death (travel, illness, lost access to email). You accept this risk. We provide a 24-hour final-undo window before execution as a courtesy, not a guarantee.

5. Service continuity

If we discontinue the Service, we will provide at least 90 days' notice and a data export. We will not dispatch instructions during wind-down except by your trigger. We do not guarantee uninterrupted or error-free operation.

6. Payment and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. The amount, currency, and any applicable taxes are shown at checkout. Payment terms, billing, tax handling, cancellations, and refunds are governed by the Paddle Checkout Buyer Terms.

See our Refund Policy. In short: we offer a 30-day money-back guarantee, processed through Paddle at paddle.net.

8. Intellectual property

lastword.to and all related software, documentation, branding, and content are owned by lastword.to and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable right to use the Service for its intended purpose. You may not reverse engineer, resell, or circumvent technical limits of the Service. You retain ownership of the instructions and content you store; you grant us a limited license to host and process that content solely to operate the Service for you.

9. Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated/serious policy violations. You may close your account at any time from your settings.

10. Inactive accounts

Unpaid accounts that have zero activity for a period of 1 year will automatically be deleted. This is to keep our operating costs down and so we do not retain any personal and sensitive data unnecessarily.

11. Disclaimers and limitation of liability

To the maximum extent permitted by law, the Service is provided "as is" without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose. Our aggregate liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages (including loss of profits, data, or goodwill), except where such liability cannot be excluded by law.

12. Changes to these terms

We may update these terms from time to time. Material changes will be communicated by email or in-app notice before they take effect.
